General Term and Conditions

We are PT. Top Indonesia Holidays (“We”, “us”, and “our”) of Tuban Plaza 42, Bypass Ngurah Rai Kuta, Bali 80361. This General Term and Condition “Agreement” is a legal contract between “you” and “your” and Top Indonesia. The Agreement covers your use of Top Indonesia’s services. If you’re a travel agent booking for a client, you agree to these terms for yourself and the client. You’ve shared and explained this Agreement to the client, who agreed, and you’re authorized to bind the client to these terms.

This Agreement covers the following services:
You can request a personalized trip for you or your client (called a “Bespoke Trip”) for hotels, tours, and more; you send your request to Top Indonesia (called a “Package”); Top Indonesia creates an itinerary (called the “Road Map “) In the package it consists some tour element that we buy from third party from other travel providers (like tours, hotels, transport) as their company (called “Suppliers”); Top Indonesia helps with further services related to your trip (called your “Planning Trip”).

By accepting any of the Services, you now acknowledge and consent to be legally bound by the stipulations outlined in the Terms and Conditions of this Agreement.

1. Booking Process:

a. To make a Bespoke Trip request, fill in this form and email it to [email protected]. We’ll send you a basic itinerary (without prices) within 24 hours of receiving your request.

b. After you submit a Booking Request, we’ll check if the Package elements like tours, accommodations, transfers, and room options are available. Then, we’ll pre-block the tour element temporarily, create a detailed Itinerary and estimate the total price. You’ll get a chance to review it. Nothing will be reserved until you agree to the final Itinerary and pay any required amounts.

c. All prices quoted to you are in United States Dollars, nett including local tax, non-commissionable and valid to the specified date, and invoices issued to you.

2. Confirmation and Payment:

a. Confirmation: Once you agree to the Itinerary, we’ll email you a Confirmation Invoice with the final price and all the details. Please check it and advise any revisions you want to make. We will revise it immediately.
b. Rate and Inclusions: We pre-negotiate specific room rates with hotel suppliers. The rate quoted to you is net and includes 11% government tax and 10% service charges. Other inclusions and benefits will be written on the invoice.

c. Special Request: Please let us know in advance if you have any special requests, like dietary needs, preferred room type, or specific flight seats important to your trip. We’ll pass your request on to our supplier. We do our best to fulfil your request, although we can’t guarantee it. We will forward it to you as soon as we have written confirmation from suppliers.

d. Payment: After you decide to buy the services we’ve confirmed, you need to send us payment within 48 hours. We can only accept payment through wire transfers or major credit cards like Visa or MasterCard via Online Payment Gateway:

d1. A 30 % deposit payment from the total amount of the package price is due to secure booking.
d2. Unless we agree in writing, the total balance must be settled at least 45 days before customer’s arrival at the destination.
d3. There could be exceptions to the above payment terms if the policies of hotels, airlines, cruises, or other suppliers we work with require more time or an advance payment. If, for any reason, we don’t receive payment as soon as needed, your booking may be cancelled, and your reservations may be released.

3. Cancellation:

Should you wish to cancel any services, you must notify us in writing via email. Please state the reason for cancellation in your correspondence, as your insurance policy may cover you. We offer flexibility in terms of cancellation based on circumstances. We standardize the general cancellation charge as follows:

1. More than 30 days: 20% of total Services
2. 15-30 days: 30% of total Services
3. 7-15 days: 50% of total Services
4. Within 7 days: 100% of total Services

Apart from our general cancellation policy, individual suppliers such as hotels, Boats and Airlines may have their own rules. We will share their policy You agree to check these policies before making travel plans and agree to cover any fees.

4. Hotel No-Show:

If you do NOT show up on the first night of your hotel reservation but still intend to check in for the rest of your stay, you need to inform us of this change by the date of the first night to avoid cancellation. If you don’t show up at the hotel, you may be charged the total amount, including taxes and fees.

5. Liability:

a. Website Contents: Our website might have errors or inaccuracies in product, service, and pricing information. We welcome your feedback to help us improve.

b. Third Party / Supplier Liability: Suppliers are separate entities. We and our affiliates are not responsible for their actions, errors, or any harm or expenses, such as personal injuries or property damage. We won’t offer refunds for events beyond our control, like delays, cancellations, or government actions.

c. Force Majeure: Both parties are not held responsible for any delays or failures in this
Agreement caused by factors beyond their control, such as Acts of God, government restrictions, wars, insurrections, or similar circumstances.
